Pennsylvania Skill wins case in Commonwealth Court
Attorneys representing Pace-O-Matic of Pennsylvania (POM of PA) received an opinion on November 20, 2019 from the Pennsylvania Commonwealth Court regarding litigation we brought against the Commonwealth of Pennsylvania Department of Revenue and the City of Philadelphia ...And we won Decisively.
The opinion, from a statewide appellate court, states that our Pennsylvania Skill games are NOT regulated by the Gaming Act as argued by the state.
As you are aware, the Beaver County Court of Common Pleas previously ruled Pace-O-Matic’s Pennsylvania Skill legal, as games of predominant skill.
These two rulings put our games on solid ground and you should feel comfortable operating one of only two court adjudicated games in the Commonwealth. (The other legal game is manufactured by Red, White, and Blue.)
Further in the court decision released on Wednesday November 20, 2019, Pennsylvania Commonwealth Court ruled that the enforcement of illegal gambling devices is a criminal matter and is the responsibility of the Pennsylvania State Police, Bureau of Liquor Control & Enforcement.
